I. General Terms
By commissioning me in any kind of way, you are agreeing to the terms of service below.I, the artist, retain full and exclusive rights to the original artwork. There will be no use of the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space. The client will not claim the art as their own. The work will only be for personal use for example: Twitter icons, banners, Twitch descriptions, and gifts. I retain the right to use the completed work as examples on my site or may post it on my social media and portfolio. If you wish to keep the commission private please check that option off on the form.All Commissioned work is for noncommercial use unless bought for commercial use. Commercial use is anything that includes you profiting from the product, such as merchandise and game illustrations. Redistribution of my work in prints, shirts or other merchandise is not permitted without the added commercial use fee. I understand you want to sell nice things. The fee will be far less than how much you will get in the long run. The Twitch emotes are already charged for commercial use and are exempt from this. If you have any questions about this feel free to ask before or during a commission.Conditions for reposting are as follows: Please provide a link back to my Carrd or Twitter to give proper credit when reposting. The commissioned work with the signature unaltered may be reposted by the user anywhere they like as long as the signature is visible or credit is given. You may ask for a variety of cropped uses for the piece that have the signature visible or different variants of the signature that look more appealing as well.Prohibited actions are as follows: Alteration of artwork without permission. Resizing and cropping is accepted as long as the signature is visible or credit is given. I can provide different cropped versions of a commissioned piece for free when asked before or after work is complete. Using my artwork as references for tracing or re-purposing parts of the image is not allowed.Terms of service can be discussed with me at any time as these are precautions. Communication is important to me and can solve most issues that may occur at any given time. I will always discuss things before I take action at any time. Thank you!
II. Payment & Cancellations
Commissions must be paid in full before work begins. The currency accepted is USD. An invoice will be sent via PayPal from the artist to commissioner after the form is settled and discussed. Alternatively Ko-fi is being used for non-custom commission types. If preferred, creation of a private Ko-fi listing for custom commission payments can be done as well.Chargebacks: If you file a chargeback against me, your right to everything I have ever made for you will be retracted.Cancellation: Once work has reached the line art stage there will only be a 50% refund of the original cost. Any work after this cannot be refunded or cancelled. During the sketch phase a cancellation with a full refund can be requested. Under the circumstance you want to keep the sketch we can arrange a fee based on completion to keep the current work to continue at another time.I hold the right to cancel and refund the money for your commission at any time. This shall be done under extreme circumstance and is not to be abused by I, the artist.
III. Process
Conditions for viewing and asking for work in progress: The commissioner may ask to see work after a sketch is complete or in progress. They may also request or ask for any change at this time. They have up to three requests per commission to view and address any changes. The commissioner may send a formal email with their username associated with the commission upon a request and then discuss further via twitter. Similarly they may send a direct message on twitter and get a more delayed reply before further discussion.To keep an eye on progress I will update Trello daily for those that are shy or want to wait until a certain pointKey points of progress: Work that is detailed or close to being finalized I the artist will send out a work in progress to the commissioner. This is to ensure they are receiving the quality they desire and that the persona is drawn accurately. This does not count towards the ask request as it is a separate part of the process and considered a courtesy. Work in progress backgrounds will also be sent out to those who commission detailed backgrounds.The key points of the work I will always send are of the sketch, lineart and flat colour stages.Changes: In order to satisfy the customer I will allow changes to be made during the initial process of the work before finalization. Finalization in this instance will refer to any process after linework is complete such as the shading, coloring and addition of a background for a work. After this instance a fee will be incurred for any changes that are not minor. Minor refers to small coloring and line mark mistakes. Changes that require redrawing or adding and subtracting that was not discussed previously will be charged and discussed with the commissioner on a case by case basis. Process will not move forward until the fee is paid , unless you have already commissioned me once before and thus will be able to pay the fee at the time of completion. At the current time I will allow any changes to the background that do not fall under the fully shaded or watercolor category at no extra charge.Deadlines: The time for your commission to be completed can vary from a week or up to 3 months depending on many factors such as; health, order of commission, complexity, work, school or family issues.
If any of the things stated above occurs you will be notified asap.For rush orders I will only accept them if I can make the deadline otherwise I will decline the order.Delivery: Customer agrees that product will be delivered digitally to email address provided by customer, after the final payment has been received by the seller.A Google drive link will be provided to those who would prefer to not be emailed directlyAny other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Customer is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.It is sole responsibility of customer to propose delivery method which works for both parties. Seller cannot be held accountable for customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the seller.Upon delivery of the product, it is the customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the seller. seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.
